The IDEA Regulation Section 300.38 along with No Child Left Behind incorporates statutory requirements related to the inclusion of children with disabilities in general state and district-wide assessment programs, including assessments described under the Elementary and Secondary Education Act (ESEA), with appropriate accommodations and alternate assessments where necessary and as indicated in their respective individualized education programs (IEPs). In response to this federal mandate, the STAAR Assessment Program includes special education students in testing using STAAR or STAAR Alternate 2.
